These Terms of Service (“Terms”) govern your relationship with Parler Technologies, Inc. (“Parler Play,” “we,” “us,” or “our”) and your use of and access to all services, websites, applications, products, livestream channels, and features provided through the Parler Play experience (collectively, the “Services”).

By accessing or using any part of the Services, you agree to be bound by these Terms, including the Parler Play Privacy Policy and Parler Play Community Guidelines, which are incorporated herein by reference.

Eligibility

You may not use the Services unless all of the following apply to you:

  • You are at least 18 years old;
  • You are legally permitted to use the Services where you reside;
  • You are not using the Services on behalf of an entity unless you are authorized to bind that entity;
  • You have not been banned or suspended by Parler Play.

Privacy

The Parler Play Privacy Policy describes how we collect, use, store, and transfer information. By using the Services, you consent to our data practices as described therein, including international data transfers where applicable.

User Content Standards

Any content you post must:

  • Be lawful;
  • Not infringe intellectual property rights;
  • Not contain private personal information of others;
  • Comply with applicable laws and regulations;
  • Comply with the Parler Play Community Guidelines.

You are solely responsible for your content. Parler Play does not endorse or verify user-generated content.

Acceptable Use Policy (AUP)

You agree not to:

Illegal or Harmful Conduct

Upload or distribute unlawful, defamatory, obscene, abusive, fraudulent, or harmful content.

System Abuse

  • Access unauthorized areas;
  • Attempt to breach security;
  • Introduce malware;
  • Interfere with service integrity.

Automated Abuse

Use bots, scrapers, or automated systems without written authorization.

Misrepresentation

Impersonate others, commit fraud, or conduct unauthorized commercial activity.

Metrics Manipulation

Artificially inflate views, engagement, or rankings.

Data Misuse

  • Harvest or disclose personal information without authorization.
  • Violation may result in suspension, termination, or legal action.

Messaging Features

  • Parler Play may provide users with the ability to send or receive direct messages or other communications within the Services.
  • All messaging activity is subject to the Parler Community Guidelines, Acceptable Use Policy, and any applicable messaging or conduct policies published by Parler.
  • Users may not use messaging features to harass, threaten, defraud, spam, distribute unlawful content, or otherwise violate Parler policies or applicable law.
  • Parler may monitor, restrict, suspend, or terminate messaging access at its discretion to enforce these policies or protect users and platform integrity.

Third-Party Livestream Channels

Parler Play may provide access to third-party linear broadcast channels, including but not limited to Newsmax and other media partners (“Livestream Channels”).

These may include:

  • Continuous 24/7 livestream programming;
  • Scheduled broadcast content;
  • Electronic program guide (EPG) listings;
  • Automatically published video-on-demand (VOD);
  • Real-time chat functionality;
  • Integrated tipping or payment features.

Third-Party Content Disclaimer

Livestream Channels are operated by independent third-party media partners.

Parler Play:

  • Does not create, produce, edit, or control broadcast content;
  • Does not endorse or verify statements made during broadcasts;
  • Is not responsible for the accuracy, legality, or reliability of third-party programming.

All broadcast content remains the sole responsibility of the originating broadcaster.

Continuous Broadcast Availability

Parler Play does not guarantee:

  • Continuous stream availability;
  • Specific programming schedules;
  • Real-time, uninterrupted playback;
  • Error-free streaming.

Livestreams may be delayed, interrupted, modified, or removed at any time without notice.

Live Chat Around Livestream Content

Parler Play may enable real-time chat in connection with livestream content.

Users acknowledge:

  • Chat content is user-generated;
  • Chat may not be monitored in real time;
  • Parler Play does not endorse chat content.

Users may not use chat to:

  • Harass or threaten others;
  • Spread unlawful content;
  • Mislead users about payment or tipping;
  • Solicit funds fraudulently;
  • Promote illegal goods or services.

Parler Play may remove chat content, disable chat access, suspend accounts, or report unlawful activity.

Tipping & Payments

Parler Play offers optional tipping features, including Super Comments.

General Rules

  • All payments are voluntary;
  • Payments do not guarantee responses, content changes, or preferential treatment;
  • All transactions are final and non-refundable unless required by law;
  • Parler Play does not mediate tipping disputes.

Livestream Tipping

Where tipping is enabled during livestream content:

  • Payments are made at user discretion;
  • Payments do not establish contractual obligations with broadcasters;
  • Parler Play is not responsible for broadcaster conduct or representations.

Users are responsible for tax compliance and understanding payment terms.

Commerce & Marketplace Features

  • Parler Play may allow users to discover, purchase, or interact with products offered through Parler Shop or third-party merchants (“Marketplace Sellers”).
  • Parler does not manufacture, store, or ship products listed by Marketplace Sellers and is not responsible for product quality, safety, delivery, warranties, or representations made by sellers.
  • Purchases made through Parler Play, including purchases completed through guest checkout, are governed by the applicable Parler Shop Terms and the Parler Privacy Policy, which are incorporated herein by reference.
  • By completing a purchase through Parler Play, you acknowledge that your transaction is with the Marketplace Seller and agree to the applicable commerce terms governing that transaction.
  • Parler does not mediate disputes between buyers and sellers unless required by applicable law.

Digital Asset Disclaimer (OPT Tokens)

OPT tokens are utility tokens within the ecosystem.

They are:

  • Not securities;
  • Not investments;
  • Subject to volatility;
  • Used at your own risk.

Parler Play makes no guarantees regarding value or liquidity.

CSAE Zero-Tolerance Policy

Parler Play strictly prohibits content related to child sexual abuse and exploitation (CSAE).

Violations will result in:

  • Immediate account termination;
  • Reporting to law enforcement;
  • Cooperation with NCMEC and authorities.

We use automated moderation tools and human review to detect violations.

Intellectual Property

  • All Services, including software, content, branding, and design, are owned by Parler Play or its licensors.
  • You grant Parler Play a worldwide, non-exclusive, royalty-free license to use content you post.

Account Security

  • You are responsible for maintaining account confidentiality.
  • Parler Play may disable accounts at its sole discretion.
  • Inactive accounts (9 months) may be removed.

Geographic Restrictions

  • The Services are intended for use within the United States.
  • Access outside the U.S. is at your own risk.

Platform Features & Integrated Services

  • Parler may introduce additional features or integrated services within Parler Play from time to time, including but not limited to digital wallets, tipping systems, creator monetization tools, affiliate commerce programs, livestream enhancements, or other interactive functionality.
  • Use of such features may be subject to additional terms, policies, or guidelines published by Parler at the time the feature becomes available.
  • Your use of these features constitutes acceptance of the applicable terms governing those services.

Service Modifications

Parler Play may modify, suspend, or terminate Services at any time without liability.

Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS.”

Parler Play disclaims all warranties, including merchantability and fitness for a particular purpose.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PARLER PLAY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

This includes damages arising from:

  • Third-party livestream content;
  • Broadcast statements;
  • Live chat interactions;
  • Tipping activity;
  • Stream interruptions;
  • Blockchain features;
  • Digital assets;
  • Unauthorized access or hacking events.

Total aggregate liability shall not exceed the greater of:

  • $200 USD; or
  • The amount you paid Parler Play in the past six months.

Indemnification

You agree to defend and indemnify Parler Play from any claims arising from your use of the Services.

Arbitration & Governing Law

  • These Terms are governed by Nevada law.
  • Disputes shall first be submitted to good-faith mediation within sixty (60) days of written notice of the dispute. If the dispute is not resolved through mediation, it shall be resolved through confidential binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules in the State of Nevada.
  • If unresolved, disputes may be submitted to confidential arbitration under AAA Commercial Arbitration Rules in Nevada.
  • You waive the right to jury trial.

Blockchain Integration

Blockchain features may be integrated into the Services.

Users acknowledge:

  • Blockchain carries inherent risks;
  • Parler Play does not control network performance;
  • Users are responsible for managing private keys.

Modifications to Terms

  • Parler Play may update these Terms at any time by posting revisions.
  • Continued use constitutes acceptance.
