Parler Play Terms of Service

These Terms of Service ("Terms") govern your relationship with Parler Technologies, Inc. ("Parler Play," "we," "us," or "our") and your use of and access to all services, websites, applications, products, livestream channels, and features provided through the Parler Play experience (collectively, the "Services").

By accessing or using any part of the Services, you agree to be bound by these Terms, including the Parler Play Privacy Policy and Parler Play Community Guidelines, which are incorporated herein by reference.

Eligibility, Privacy, and User Content Standards

• You must be at least 18 years old.
• You must be legally permitted to use the Services where you reside.
• You may not use the Services on behalf of an entity unless you are authorized to bind that entity.
• You must not have been banned or suspended by Parler Play.

The Parler Play Privacy Policy describes how we collect, use, store, and transfer information. By using the Services, you consent to our data practices as described therein, including international data transfers where applicable.

Any content you post must be lawful, must not infringe intellectual property rights, must not contain private personal information of others, must comply with applicable laws and regulations, and must comply with the Parler Play Community Guidelines. You are solely responsible for your content.

Acceptable Use Policy (AUP)

• Illegal or Harmful Conduct: Do not upload or distribute unlawful, defamatory, obscene, abusive, fraudulent, or harmful content.
• System Abuse: Do not access unauthorized areas, attempt to breach security, introduce malware, or interfere with service integrity.
• Automated Abuse: Do not use bots, scrapers, or automated systems without written authorization.
• Misrepresentation: Do not impersonate others, commit fraud, or conduct unauthorized commercial activity.
• Metrics Manipulation: Do not artificially inflate views, engagement, or rankings.
• Data Misuse: Do not harvest or disclose personal information without authorization.

Violations may result in suspension, termination, or legal action.

Messaging, Livestreams, and Payments

Parler Play may provide direct messages or other communications within the Services. Messaging activity is subject to the Community Guidelines, Acceptable Use Policy, and any applicable messaging or conduct policies published by Parler. Parler may monitor, restrict, suspend, or terminate messaging access at its discretion.

Parler Play may provide access to third-party linear broadcast channels, including Newsmax and other media partners. These may include 24/7 livestream programming, scheduled content, EPG listings, automatically published video-on-demand, real-time chat, and integrated tipping or payment features.

Third-Party Content Disclaimer. Livestream Channels are operated by independent third-party media partners. Parler Play does not create, produce, edit, or control broadcast content, does not endorse or verify statements made during broadcasts, and is not responsible for the accuracy, legality, or reliability of third-party programming.

Parler Play does not guarantee continuous stream availability, specific programming schedules, uninterrupted playback, or error-free streaming. Livestreams may be delayed, interrupted, modified, or removed at any time without notice.

Parler Play may enable real-time chat around livestream content. Chat content is user-generated, may not be monitored in real time, and is not endorsed by Parler Play. We may remove chat content, disable chat access, suspend accounts, or report unlawful activity.

Parler Play offers optional tipping features, including Super Comments. All payments are voluntary, do not guarantee responses or preferential treatment, are final and non-refundable unless required by law, and Parler Play does not mediate tipping disputes.

Commerce, Digital Assets, and CSAE

Parler Play may allow users to discover, purchase, or interact with products offered through Parler Shop or third-party merchants ("Marketplace Sellers"). Parler does not manufacture, store, or ship products listed by Marketplace Sellers and is not responsible for product quality, safety, delivery, warranties, or seller representations.

OPT tokens are utility tokens within the ecosystem. They are not securities, not investments, are subject to volatility, and are used at your own risk. Parler Play makes no guarantees regarding value or liquidity.

Parler Play strictly prohibits content related to child sexual abuse and exploitation (CSAE). Violations will result in immediate account termination, reporting to law enforcement, and cooperation with NCMEC and other authorities. We use automated moderation tools and human review to detect violations.

Intellectual Property, Security, and Geography

All Services, including software, content, branding, and design, are owned by Parler Play or its licensors. You grant Parler Play a worldwide, non-exclusive, royalty-free license to use content you post.

You are responsible for maintaining account confidentiality. Parler Play may disable accounts at its sole discretion. Inactive accounts for nine months may be removed.

The Services are intended for use within the United States. Access outside the U.S. is at your own risk.

Platform Features, Disclaimers, and Liability

Parler may introduce additional features or integrated services within Parler Play from time to time, including digital wallets, tipping systems, creator monetization tools, affiliate commerce programs, livestream enhancements, or other interactive functionality. Use of such features may be subject to additional terms, policies, or guidelines published by Parler at the time the feature becomes available.

Parler Play may modify, suspend, or terminate Services at any time without liability. THE SERVICES ARE PROVIDED "AS IS." Parler Play disclaims all warranties, including merchantability and fitness for a particular purpose.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PARLER PLAY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING DAMAGES ARISING FROM THIRD-PARTY LIVESTREAM CONTENT, BROADCAST STATEMENTS, LIVE CHAT INTERACTIONS, TIPPING ACTIVITY, STREAM INTERRUPTIONS, BLOCKCHAIN FEATURES, DIGITAL ASSETS, OR UNAUTHORIZED ACCESS OR HACKING EVENTS. TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF $200 USD OR THE AMOUNT YOU PAID PARLER PLAY IN THE PAST SIX MONTHS.

Indemnification, Arbitration, Blockchain, and Modifications

You agree to defend and indemnify Parler Play from any claims arising from your use of the Services.

These Terms are governed by Nevada law. Disputes shall first be submitted to good-faith mediation within sixty (60) days of written notice. If unresolved, disputes may be submitted to confidential arbitration under AAA Commercial Arbitration Rules in Nevada. You waive the right to jury trial.

Blockchain features may be integrated into the Services. Users acknowledge that blockchain carries inherent risks, Parler Play does not control network performance, and users are responsible for managing private keys.

Parler Play may update these Terms at any time by posting revisions. Continued use constitutes acceptance.
